Lao Động Việt yêu cầu Puma và Asics can thiệp với Diamond













Lao Động Việt vừa gởi thư đến công ty Puma và cty Asics, yêu cầu họ đòi công ty Diamond nhận lại công nhân và bồi thường thỏa đáng. Ngay sau khi gởi email, chúng tôi đã nhận được email trả lời của TS. Reiner Hengstmann, Giám Đốc Thế Giới về “Safe” của Puma, nói ông đã mở cuộc điều tra. Bà Lillian Tseng, Giám Đốc Nhóm CSR của Asic, cũng trả lời rằng sắp điều tra. Sắp tới, khi có tiến triển, LĐV sẽ cập nhật.



Xin nhắc lại, cuối tháng 7 cty Diamond ra thông báo lập tức đuổi công nhân trong danh sách có tên 138 người. Một số công nhân đã yêu cầu Phong Trào Lao Động Việt can thiệp. Hiện nay PTLĐV đang tìm luật sư để đại diện cho một số công nhân kiện Diamond ra tòa. Đồng thời, Lao Động Việt gởi thư đến Puma và Asics, là 2 đại công ty ngoại quốc đặt hàng với Diamond.

“Một số công nhân đã liên lạc với một nhóm thành viên của liên minh chúng tôi, là Phong Trào Lao Động Việt. Chúng tôi yêu cầu ông đảm bảo rằng Diamond sẽ nhận việc lại tất cả mọi công nhân, dù đã viết thư đến Diamond hay không. Nếu có công nhân nào vẫn nghỉ, thì Diamond phải bồi thường đúng mức cho họ. Theo những tin tức mà Phong Trào Lao Động Việt đã thu thập được thì:

● Diamond không thông báo đủ ngày: Theo luật thì phải báo trước 45 ngày, nhưng Diamond báo trước 1 ngày;

● Diamond đuổi tùy tiện: Thông báo nói rằng đuổi do lý do kinh tế, nhưng các công nhân khác vẫn tăng ca. Thông báo nói chỉ đuổi những ai thi rớt tay nghề, nhưng một số người thi đậu vẫn bị đuổi. Sự thật là, Diamond đuổi những ai làm lâu năm để bớt chi phí;

 Diamond đe dọa công nhân: Ngày thông báo, Diamond đã thu xếp để có một dàn công an và bảo vệ đông đảo, rồi đại diện của Diamond đe dọa công nhân rằng nếu không ký giấy nghỉ việc thì không được tiền bồi thường. Một số công nhân vì cảm thấy bị đe dọa nên đã ký;

Diamond toan tính bồi thường ít hơn mức luật định: Lẽ ra, khi đơn phương đuổi người, thì Diamond phải tuân theo Điều 49 của Bộ Luật Lao Động, trả 1 tháng cho mỗi năm từng làm việc, nhưng ngay cả nếu ai làm dưới 2 năm thì vẫn phải trả họ 2 tháng lương. Như trên nói, Diamond ép buộc công nhân để ký, biến từ đuổi đơn phương qua thỏa thuận song phương, Diamond làm vậy vì họ muốn thay vì phải dùng Điều 49 thì được dùng Điều 48, chỉ nửa tháng cho mỗi năm. Nhưng dù cho Điều 48 áp dụng thì những ai làm 4 năm cũng phải được 2 tháng lương thay vì 1 tháng rưỡi như Diamond dự định”

Viet Labor has just written to Puma and Asics, asking them to require Diamond to reinstate workers and pay proper compensation payments. Soon after that, we received a reply from Dr. Reiner Hengstmann, Safe Global Director of Puma, saying he’s started an investigation. Ms Lillian Tseng, Manager of Asics’ CSR team, has also replied, saying it will investigate. As this matter progresses, Viet Labor will provide updates.

In late July, Diamond gave Notice sacking workers in a list of 138. Some of these workers then contacted Viet Labor Movement, seeking help. Currently VLM is looking a lawyer to take Diamond to court. Concurrently, Viet Labor wrote to Puma and Asics, 2 multinationals contracting with Diamond.

Diamond sacks more than 138 workers illegally

A Viet Labor affiliate, Viet Labor Movement, has been approached by workers of Diamond, a Puma supplier, in the Mỹ Phước 1 Industrial Zone, Bến Cát, Bình Dương province, about unfair sackings and underpayment of separation benefits. We ask you to ensure that all workers – not just the few who have lodged written complaints – are reinstated, and proper separation payments are made to those who want to leave. Below are the facts we have gathered:

Insufficient notice: In a case of unilateral termination like this, Article 38 of the 2012 Labor Code applies, and its Clause 2.a requires a notice of “[a]t least 45 days for labor contracts without fixed term”, ie. the kind of contract the sacked workers were on. Instead, the Notice gave 1-day: Diamond’s Notice (Photograph, next page), dated 18th July 2014, cited the legal requirement of giving 1-1.5 months notice, but gave 1 day’s notice: “Workers in the list do not need to report to work on 19/7, those who do will not be paid for”;

Arbitrary sacking: The Notice cited economic reasons (“After the events of 13 May 2014, the Company suffered heavy damages including a fire, and had to reduce production as it had reduced orders”), but workers told us that all other workers were working overtime as usual. And it wrote “To be laid off: workers who produce no results, or have worked for many years but can do only unskilled tasks, or workers who fail skills tests…”. Several had passed skills tests. They had been with the company for some years, therefore their wages were higher than new workers’ – this is the real reason for the sacking;

Intimidation of workers: At the 19 July meeting, company representatives told workers that they were sacked on the spot, and that if they did not sign separation papers then and there, they would get no separation payment. The company had arranged for a large contingent of police and security guards on site. Workers told us that this caused some workers to feel intimidated and sign;

Separation payments below levels required by law: By putting workers under duress to sign separation papers, as above, the company misleadingly used the lower “Severance pay” under Article 48 (for mutually-agreed termination, at ½ month per year of employment) while in reality a higher payment applies: Article 49, “Redundancy pay” (for a unilateral termination due to “economic reasons”) requires a benefit of 1 month per year, and a worker with less than 2 years service still gets 2 months. In other words, the company offers workers less than 50% of their legally entitled severance. Furthermore, even if Article 48 applied, for workers having worked for 4 years or more, the payment must be 2 months, not 1½ months.
